Terms of Use for TrackYourGrow

1. Acceptance of Terms

By using the TrackYourGrow (“App”), you agree to comply with these Terms of Use (“Terms”). If you do not agree, please discontinue use of the App.

2. Description of Service

TrackYourGrow is a mobile application designed to help users track the growth of cannabis plants. The App allows you to log plant data, take photos, set reminders, manage grow box configurations, secure app access with a PIN, and export/import data via backups, with all data stored locally on your device.

3. User Responsibilities

• You are responsible for all activities conducted through your use of the App.
• You must use the App only for lawful purposes and in compliance with all applicable laws, including those related to cannabis cultivation in your jurisdiction.
• You are responsible for maintaining the security of your device, including any PIN set for app access and any backup files exported or shared.
• If you share backup files (e.g., via email or messaging apps), you are responsible for ensuring the recipient’s handling of the data complies with applicable laws and privacy standards.
• If you enable the PIN feature, you are responsible for remembering the PIN. Forgetting the PIN requires resetting the App, which deletes all locally stored data.

4. Permissions and Usage

The App requires the following permissions, which you must grant to use its features:

• Camera: To take photos of your plants, stored locally.
• Notifications: To send reminders (including vibration), which you can disable in device settings.
• Internet Access: To send support emails to support@trackyourgrow.com, with your email as the Reply-To address, to handle purchases, and to access external services (website, social media, community platforms).
• File Storage and Access: To save and load plant photos, and to export/import backup files (ZIP format) containing plant data, photos, and logs.
• PIN Authentication: To secure app access with a user-defined PIN, if enabled.

5. Intellectual Property

The App and its content, including design and functionality, are protected by intellectual property laws. You may not reproduce, distribute, or modify the App without explicit permission.

6. Limitations of Liability

The App is provided “as is” without warranties of any kind, either express or implied. The provider is not liable for:

• Any indirect, incidental, or consequential damages arising from your use of the App, including data loss due to forgotten PINs, failed backups, or improper sharing of backup files.
• Legal issues related to cannabis cultivation or the sharing of backup files containing plant data.
• Data loss resulting from resetting the App due to a forgotten PIN, as the PIN is stored locally and cannot be recovered.

7. Changes to Terms

The provider reserves the right to modify these Terms at any time. Updated Terms will be available in the App’s About page, and continued use constitutes acceptance of the changes.

8. Subscriptions and Payments

TrackYourGrow offers subscription plans that provide access to premium features, such as the creation of unlimited environments and plants and the backup feature. Current subscription pricing is available within the app and on the app’s store page.

8.1 Subscription Plans

Subscriptions are available on a recurring basis or as a one-time purchase for lifetime access. The specific features included in each plan are detailed within the app.

8.2 Billing and Auto-Renewal

Subscriptions are billed in advance and auto-renew at the end of each billing period unless canceled. You can manage your subscription and turn off auto-renewal through your device’s settings or the app’s subscription management section.

8.3 Cancellation and Refunds

You can cancel your subscription at any time, and it will remain active until the end of the current billing period. No refunds are provided for the current billing period upon cancellation. For one-time purchases, refunds may be available within 48 hours of purchase through Google Play or the App Store, subject to their respective refund policies. After 48 hours, refunds for one-time purchases are not available unless there is a specific issue, such as defective content, and are at the discretion of the developer.

8.4 Changes to Subscription Terms

We may update subscription terms, including pricing, at any time. Any changes will be communicated through the app or via email, and your continued use of the subscription after such changes constitutes acceptance of the new terms.

9. External Links and Third-Party Services

The App provides links to external platforms (Website, Instagram, Discord) for community and information purposes.

• Community Rules: Access to our Discord server requires the explicit acceptance of our Community Rules, including a strict 18+ age requirement and a zero-tolerance policy regarding the sale or distribution of any goods or substances.
• Liability: We are not responsible for the content, privacy practices, or conduct of third-party services. We do not endorse or assume liability for user-generated content on these platforms.
• Risk: Use of external links and participation in community platforms is at your own risk and must comply with your local laws.
• Internet Access: Required for support, purchases, and accessing these external services.
